Answered in the ticket, but I think Bodhi is behaving correctly there. When trying to merge the side tag, if Bodhi find a more recent build in the target tag it will push back the update to pending and comment on the update that there are more recent builds in the target tag. Then it is up to the packager to resolve the conflict (either rebuild the conflicting packages or remove them from the update).
