Regarding the patent issues, I haven't fully researched the issue, but I was recently referred to these links by someone who uses VTK:

It sounds to me like the patented subdirectory was removed from the source tree with release 5.0 because of the problems it was causing. If you have trouble getting a response from the upstream developers, the package is in Debian, so you might consider contacting the Debian packager for more information.
