I *believe* that "Fedora software" is anything that we package and ship in our repositories.  That doesn't make upstream "Fedora software", though.

Upstream software doesn't suddenly become "Fedora software" unless upstream decides to exclusively write the software for Fedora or, perhaps better put, the software is developed within the Fedora Project.

This is a question for Legal.  My understanding, however, is that in general because the Fedora Project is based out of the US we would be subject to EAR because we ship things like cryptography.

I'd ask Legal directly about the EAR stuff as they have a much better working knowledge of export law that I have.
