Would it still be the same case if you distributed a package containing the yum repo file for something like the Flash repo (http://macromedia.mplug.org/rep_uh.html) ?

in some jurisdictions there is a legal precedent for linking to
"illegal" content to be just as bad as distributing it. Now I'm not
saying that the flash plugin is illegal (it's not afaik) but the
parallel is enough to scare many lawyers ;)

Especially if such methods avoid click-through and advertisement
webpages that the publisher really intends for you to watch and go
through.
