Microsoft, Linux, RH and patents....

Microsoft my indemnify some RH users.  OK.  From what ?  GPL code is not
supposed to contain any patent infringements.  So what is Microsoft
promising not to sue about ?  What patents does Microsoft hold over
Linux ?  

Is this going to be a repeat of the SCO debacle wherein SCO never did
find any infringements ?

What am I missing here ?
