That's news to my ears; where did you hear this from? Considering Red Hat's yum repositories contain no patent-infringing material I would think they'd be fine, in any case.

This issue has nothing to do with the software being upgraded, but about the tool or method to upgrade software with (which is most likely a crazy patent about a trivial method, but we have to deal with evil guys in this world :-( ).
